Terms and Conditions

These Terms and Conditions were most recently updated on 5th November 2017 and apply to sales to consumers.

This web site is operated by The Chocolate Shop Sevenoaks LLP (“we”, “us” or “our”). By using thechocolateshopsevenoaks.co.uk website you are bound by these terms and conditions. All use and purchases made on this web site are governed by these Terms and Conditions at any time although the Terms and Conditions governing any given use or purchase will be those in effect at the date of your order or specific use. If you use or order goods after we have published any changes you will be bound by those changes. Accordingly, you should check prior to each use or order to ensure that you understand the precise terms and conditions applicable to your site visit or purchase. To assist you in determining whether the Terms and Conditions have changed since your most recent order we will display the date when these Terms and Conditions were most recently updated.

We sell goods only to end-users.

We will confirm acceptance of your order placed directly by using thechocolateshopsevenoaks.co.uk. This will occur either by message on the website immediately after you have confirmed your order, or by us sending an e-mail to the e-mail address you have provided to us.  At the point of acceptance the purchase contract will be made and we will supply the goods to you in accordance with your order and these Terms and Conditions.

You must be 18 years old to place any order on our website.

The prices stated on the website will be inclusive of any VAT payable.

Each order you make may include a charge for delivery. If your delivery is subject to a delivery charge, it will be shown to you as a separate charge on the delivery confirmation page before you confirm your order. Any delivery charge added to your order will be dependant upon, amongst other things, the value of your order, the date and time of your delivery and your delivery address and charges may vary from week to week.

We accept payment by all major credit cards.

All orders are positively credit card sanctioned prior to despatch, so please ensure that the details you provide us with are correct. We cannot accept responsibility for an order being held back as a result of incorrect or invalid payment details being given. We require you to supply the registered address of the Credit Card holder, which is used to validate your order with your selected credit card company. Failure to supply the correct details will result in your order being held pending the supply of the correct details.

The total value of your order will be displayed on the order confirmation screen. The displayed price is the amount in pounds sterling that you will pay. If you are ordering from a non United Kingdom address the appropriate exchange rate will apply.

All prices quoted will include VAT at the appropriate rate, currently 20%. If you are eligible to reclaim the sales tax, on request we will be able to supply you with a VAT receipt.

Product and packaging are subject to change or substitution without prior notice. If necessary we will substitute for an equal or higher priced item directly, as the majority of our orders are time critical and we may not have time to contact you. If time is available we will attempt to contact you.

Nothing in these Terms and Conditions will restrict our liability for death or personal injury resulting from our negligence, breach of contract or breach of statutory duty, nor will any of these terms restrict any of your statutory rights. For further information about your statutory rights, contact your local authority Trading Standards Department or Citizen’s Advice Bureau. We will not be deemed to be in breach of contract or of these Terms and Conditions as a result of any delay in our performance or failure to perform our obligations if that delay or failure to perform is due to any cause or circumstance beyond our reasonable control including, but not limited to, fire, flood and other acts of God, strikes, riot, accident, disruption to energy supplies, civil commotion, acts of terrorism or war, breakdown of equipment, road traffic problems.

Other than as set out in the above Warranty and Liability clause, our maximum liability arising out of any order for the supply of goods to you under this contract will be limited to the retail price of the goods contained in that order.

To help us ensure the best possible service some telephone calls will be recorded.

In assessing your request for delivery of chocolates from us we may make enquiries about you including searching your records held by organisations like Experian and Equifax and credit reference agencies. We may also check your details held by the IMRG Security Alert scheme and other fraud prevention schemes.

We respect your privacy. The personal information that you give us is held with care and security. We do not sell, rent or transfer this information to third parties for their marketing purposes unless you agree otherwise. Our full privacy policy.

Our guarantee to our customers

  • Should you wish to return any chocolate item it would be most helpful if you could contact The Chocolate Shop Sevenoaks first. There are occasions when it may be unnecessary for you to be inconvenienced by sending a chocolate item back or practical to do so dependent on the type of product. Fragile, date sensitive products and sale items can not be returned if not faulty .
  • If for any reason a chocolate item you have ordered is out of stock we will contact you for your choice of replacement, the option to cancel the order or arrange a later chocolate delivery to include your original chosen chocolate item.
  • You may cancel your chocolate order up to and within 14 days of delivery (commencing the day after goods have been received by the customer) in accordance with the Distance Selling Directive (2000). A refund will be made, excluding postage, within 14 days of cancellation. We request all items are returned at the customers cost. Returned chocolates must be in perfect condition and un-opened and be returned to us using a recorded delivery. Returned items must be checked by us on arrival to be in perfect condition and any breakages or damages cannot be refunded.

If any of these Terms and Conditions is held by any court of competent authority to be unlawful, invalid or unenforceable, in whole or in part, this will not affect the validity of the remaining Terms and Conditions which will continue to be valid and enforceable to the fullest extent permitted by law.

All copyright, trademarks and all other intellectual property rights in all material or content supplied as part of this website shall remain at all times vested in us or our licensors. You are permitted to use the material data and content only for your personal use in placing orders through The Chocolate Shop Sevenoaks and you may not otherwise copy, reproduce, transmit, publish, display, distribute, commercially exploit, use or create derivative works of any material data and content on thethechocolateshopsevenoaks.co.uk website without our prior written permission. We may impose a fee on any proposed use of the material data and content contained on its website, other than for placing orders through thechocolateshopsevenoaks.co.uk website.

These Terms and Conditions will be governed by English law and the parties submit to the exclusive jurisdiction of the English courts in relation to any dispute which may arise between them.
